In deciding to make a claim it is important to appreciate the following:

• Is the other person worth suing, and will you be able to enforce an order if you succeed in your claim.
  
• Even if you win, you are unlikely to recover 100% of your legal costs.
  
• If you lose you will be responsible for paying your own legal costs and the majority of the successful party’s legal costs.
  
• If the claim is a money claim less than £5,000 it will be dealt with in the small claims court where the court is only limited costs can be recovered.
